Terms of Service

NAVIA Terms of Use

Version 2.1Effective date: 12.05.2026

This document applies together with other NAVIA legal documents. In the event of a conflict with mandatory legal provisions, such mandatory provisions shall prevail.

General Provisions and Acceptance of Terms

These Terms of Service govern access to NAVIA and use of the website, mobile application, user profiles, chats, recommendations, paid features, test features, and other related NAVIA digital services.

By creating an account, registering, viewing profiles, sending messages, paying for a subscription, purchasing a boost, or otherwise using NAVIA, the user confirms that they have read, understood, and accepted these Terms of Service, the Privacy Policy, Payment Terms, Refund Policy, Community Rules, and other applicable NAVIA documents.

If the user does not agree to these Terms or is not entitled to use NAVIA, the user must not create an account, must stop using the service, and must delete the application if installed.

These Terms apply to the maximum extent permitted by applicable law and do not limit mandatory rights of consumers, users, and personal data subjects that cannot be limited by contract.

NAVIA may be provided through a website, mobile application, app store pages, test groups, communication channels, and other interfaces directly related to the NAVIA service.

Definitions and Documents Forming the Agreement

The following meanings are used in these Terms:

These Terms shall be applied together with the Privacy Policy, Consent to the Processing of Sensitive Data, Payment Policy, Refund Policy, Community Rules, Moderation and Complaints Policy, Account Deletion Policy, and Cookie Policy, where such documents are published by NAVIA.

  • “NAVIA” means the website, mobile application, dating services, communication, compatibility, recommendations, paid features, moderation, and support services operated by the NAVIA operator;
  • “User” means an individual who creates an account or uses NAVIA;
  • “Account” means a user account in NAVIA;
  • “Profile” means information, photos, questionnaire responses, interests, values, preferences, and other data that the user posts or provides in NAVIA;
  • “Paid Features” means a premium subscription, boosts, profile resurfacing, top placement, additional features, and other paid options shown to the user before purchase;
  • “AI Features” means profile analysis, compatibility recommendations, communication suggestions, and other supportive recommendations that may be generated using automated or intelligent systems.

Age, Right to Use, and User Representations

NAVIA is intended exclusively for persons who are at least 18 years old, and who have reached the age of majority in their country or region if that age is higher than 18.

By creating an account and using NAVIA, the user confirms that:

As of the publication date of these Terms, NAVIA may not conduct mandatory prior age verification. The user is solely responsible for the truthfulness of age confirmation. NAVIA may request additional information, restrict access, suspend, or remove an account if there are grounds to believe the user violates age requirements.

NAVIA is not intended for minors. If NAVIA learns that an account was created by a person below the required age, that account may be removed and access to the service terminated.

  • they are at least 18 years old;
  • they have the legal capacity to enter into a binding agreement;
  • they use the service voluntarily and in their own interests;
  • they are not prohibited from using similar services under applicable law;
  • they do not create an account on behalf of another person and do not use another person's identity.

User Account and Data Accuracy

The user must provide accurate, up-to-date, and lawful information required for registration, profile operation, matching, communication, safety, and support.

The user is responsible for the confidentiality of login credentials, device security, and all actions performed through their account, unless such actions are caused by a NAVIA security breach.

It is prohibited to create fake accounts, use another person's photos, impersonate another person, transfer an account to third parties, sell an account, use automated access means, bypass restrictions, or create repeat accounts after blocking without NAVIA permission.

NAVIA may refuse registration, limit features, request clarification of data, temporarily suspend an account, or delete an account if the profile violates these Terms, Community Rules, law, third-party rights, or creates safety risks for users.

Service Purpose and No Guarantee of Outcome

NAVIA is a digital platform for dating, communication, compatibility search, building serious relationships, and interaction between people based on voluntarily provided data, preferences, values, and available service features.

NAVIA is not a marriage agency, religious organization, psychological clinic, legal adviser, identity verification service, or guarantor of user behavior.

NAVIA does not guarantee to the user:

The user independently makes decisions about communication, disclosure of information, meetings, relationships, payment for features, and other actions related to NAVIA use.

  • the existence of matches, messages, dates, relationships, or marriage;
  • the accuracy of all information stated by other users;
  • compatibility with a specific user;
  • the safety of interactions outside the platform;
  • continuous availability of specific features, which may be tested, changed, or discontinued.

User Content and NAVIA License

The user may post or provide to NAVIA photos, profile text, questionnaire responses, interests, dating goals, messages, complaints, feedback, and other user content.

The user retains rights to their user content but grants NAVIA a limited, non-exclusive, worldwide, royalty-free license to store, reproduce, display, technically process, adapt format, moderate, back up, and use such content for NAVIA operation, profile display, matching, safety, support, legal compliance, and protection of NAVIA rights.

This license applies only to the extent necessary for NAVIA operation and lawful service purposes, unless otherwise separately authorized by the user.

The user confirms that their content does not infringe third-party rights, is not unlawful, is not misleading, does not contain third-party personal data without lawful basis, and complies with Community Rules.

NAVIA may remove, hide, restrict, or moderate user content in cases provided by these Terms, Community Rules, Moderation Policy, and applicable law.

Faith, Denomination, Values, and Voluntary Information

NAVIA may have a Christian orientation and provide users with the option to voluntarily indicate information about faith, denomination, spiritual values, and views on family, marriage, and relationships.

Providing such information is voluntary. The user understands that if they complete relevant profile fields, this information may be displayed to other users and used for profile operation, compatibility, search, recommendations, and other NAVIA features.

If applicable law classifies such information as special, sensitive, or otherwise specially protected data categories, NAVIA processes it based on the user's separate explicit consent or another applicable legal basis.

The user may change, hide, or delete such information through available settings, where such functionality is provided, or contact NAVIA support. Withdrawal of consent may affect operation of certain compatibility and profile display features.

Geolocation and Location Features

NAVIA may use the user's precise geolocation if the user grants corresponding permission at the device, application, or service level.

Geolocation may be used to display relevant profiles, determine distance, configure search, enhance safety, prevent abuse, and improve user experience.

NAVIA is not obliged to display precise coordinates to other users. For safety purposes, the service may show approximate distance, city, region, location relevance, or another less precise indicator.

The user may disable geolocation access in device or application settings. If geolocation is disabled, some NAVIA features may be unavailable, limited, or less accurate.

Chats, Private Messages, and Communication Safety

NAVIA may provide users with the ability to exchange private messages and conduct chats within the service. As of the date of preparation of these Terms, NAVIA does not provide voice and video calls or sending attachments/photos within chat, unless implemented later.

The user is responsible for the content of their messages, respectful communication, and compliance with law and Community Rules.

NAVIA does not perform constant manual reading of all private messages. However, authorized NAVIA staff or moderators may access complaints, related profiles, disputed materials, and corresponding messages if a user filed a complaint, there is suspicion of a violation, fraud, safety threat, dispute, technical necessity, or lawful request of a competent authority.

The user understands and agrees that such review may be necessary to protect users, investigate complaints, enforce Community Rules, prevent abuse, and protect NAVIA rights.

AI Features, Recommendations, and Automated Assistance

NAVIA may use AI features and automated tools for profile analysis, profile improvement, recommending potentially compatible users, communication prompts, profile ranking, personalization of experience, and other supportive functions.

NAVIA AI features are supportive and informational. They are not psychological, medical, legal, financial, pastoral, or other professional advice.

NAVIA recommendations do not guarantee compatibility, reciprocity, quality of communication, meeting, relationship, marriage, or any specific life outcome. The user independently evaluates recommendations, makes decisions, and is responsible for their actions.

NAVIA may modify, improve, restrict, or discontinue AI features if necessary for service quality, safety, legal compliance, technical stability, or product development.

Paid Features, Subscriptions, Tokens, Boosts, and Voluntary Support

NAVIA may provide free and paid features. Paid features may include a premium subscription, additional filters, enhanced profile visibility, profile resurfacing, top placement, boosts, purchase of internal tokens, consumable digital features, upgrades, digital gifts, voluntary support of the project, and other digital options shown to the user before purchase.

NAVIA premium subscription may be provided on a monthly basis and may automatically renew until cancelled by the user, if such mechanism is explicitly indicated at the time of purchase.

Before purchase, the user must have access to essential terms: price, currency, validity period, paid feature scope, auto-renewal status, cancellation method, and applicable taxes or fees if shown separately.

Boosts, profile resurfacing, top placement, and other one-time features are digital features that may have limited duration and may depend on algorithms, audience activity, geography, user settings, and other factors.

Purchase of a paid feature does not guarantee any specific number of profile views, likes, matches, messages, dates, relationships, marriage, or other outcomes.

If a purchase is made through Apple App Store, Google Play, Stripe, or another external payment provider, payment, cancellation, and refund rules of that provider or app store may apply.

Deletion of an account or deletion of the app from a device may not by itself cancel a subscription purchased through Apple App Store, Google Play, Stripe, or another external payment provider. The user must cancel the subscription through the corresponding subscription management method, unless otherwise required by applicable law or provider rules.

NAVIA internal tokens are internal digital service units that may be purchased by the user and used only within NAVIA to access available consumable digital features, boosts, upgrades, additional options, and digital gifts to other users.

NAVIA tokens are not money, cryptocurrency, electronic money, means of payment, security, investment product, store-of-value instrument, or financial asset. Tokens are not withdrawable, exchangeable for real money, saleable, transferable outside NAVIA, or usable for payments between users.

Digital gifts, consumables, upgrades, and other items purchased with tokens are internal NAVIA digital features. They are not a money transfer, tip, donation to a user, or payout to a recipient, have no monetary value outside NAVIA, and do not give a recipient the right to demand withdrawal of funds or monetary compensation.

The user may voluntarily support NAVIA development through a separate support payment. Such voluntary support is directed to the NAVIA project and is not an investment, loan, equity purchase, security, crowdfunding for third parties, payment for a guaranteed outcome, or tax-deductible charitable donation, unless expressly stated by NAVIA and confirmed by applicable law.

If NAVIA support is accompanied by a digital thank-you mark, badge, or another symbolic element, such element is an intangible digital option within the service and is not a financial right, equity share, repayment obligation, or guarantee of special benefits, unless expressly stated before payment.

Cancellation, Refunds, and Digital Services

Subscription cancellation, refund, and withdrawal conditions for digital services are determined by these Terms, a separate Payment Policy, Refund Policy, app store or payment provider rules, and applicable law.

If the user is a consumer in a jurisdiction that provides a right of withdrawal from a distance contract, such right applies within statutory limits and exceptions. For digital services or digital content, the right of withdrawal may be limited or lost if the user consented to immediate performance and acknowledged possible loss of that right, where permitted by law.

NAVIA may refuse a refund where a paid digital feature, boost, consumable item, digital gift, or tokens have been activated, used, or duly provided, and where voluntary NAVIA support was made knowingly, except where mandatory law or payment provider rules require otherwise.

If the user believes a charge was erroneous, the user should contact NAVIA support or the relevant payment provider with purchase details, date, amount, and description of the issue.

Rules of Conduct and Prohibitions

The user must use NAVIA honestly, respectfully, safely, and lawfully. The following is prohibited:

NAVIA may take measures for violations of this section, including warning, feature restriction, content hiding, temporary suspension, account deletion, refusal of repeat registration, and referral to competent authorities where necessary and lawful.

  • creating fake profiles or impersonating another person;
  • using another person's photos, name, biography, documents, or other data without lawful basis;
  • insulting, threatening, harassing, blackmailing, discriminating, or coercing other users;
  • using NAVIA for fraud, extortion, fundraising, spam, unlawful offers, or schemes;
  • posting or sending unlawful, harmful, misleading, degrading, rights-infringing, or otherwise unacceptable content;
  • collecting data of other users without NAVIA permission and lawful basis;
  • using bots, scripts, scraping, automated tools, or technical bypass of restrictions;
  • interfering with NAVIA operation, attempting to hack the service, breaching security, or testing vulnerabilities without written permission;
  • bypassing blocks or creating repeat accounts after deletion or restriction without NAVIA permission;
  • using NAVIA in countries, territories, or situations where such use is prohibited by law, sanctions, or mandatory restrictions.

Moderation, Complaints, and Account Restrictions

NAVIA may moderate profiles, photos, descriptions, complaints, messages, disputed content, and user actions to ensure safety, compliance with Community Rules, protection of user and NAVIA rights, and fulfillment of legal obligations.

As of the date of preparation of these Terms, NAVIA may use manual moderation of complaints and related materials. Automated or AI moderation may be introduced later if NAVIA updates relevant documents and interfaces to the required extent.

NAVIA may restrict or remove an account without prior notice if a user creates risks for other users, violates law, attempts to bypass security, uses fake identity, commits fraudulent actions, or violates these Terms or Community Rules.

If applicable law requires providing the user with an explanation, appeal possibility, or other procedural mechanism, NAVIA shall act in accordance with such mandatory requirements.

The user may submit a complaint or request review through available app tools or by support email: info@navia.land.

Meeting Safety and Interactions Outside NAVIA

NAVIA does not control user actions outside the service, in-person meetings, correspondence in third-party messengers, transfers of money, gifts, personal data, or other user decisions beyond NAVIA.

The user must exercise reasonable caution in communication, not share confidential information with unfamiliar persons, not send money upon requests from other users, independently assess risks, and where necessary stop communication or file a complaint.

NAVIA may provide safety recommendations but does not guarantee identity, intentions, biography, family status, financial position, religious beliefs, psychological condition, or truthfulness of other users' data.

NAVIA Intellectual Property

All rights in NAVIA, including the name, logos, design, interfaces, software code, databases, algorithms, texts, visual elements, service structure, features, compilations, and other NAVIA materials belong to the NAVIA operator or relevant right holders.

The user is granted a limited, revocable, non-transferable, non-exclusive right to use NAVIA for personal non-commercial purposes in accordance with these Terms.

It is prohibited to copy, modify, distribute, sell, lease, decompile, create derivative products, use NAVIA branding, interface elements, or service materials without NAVIA's written permission, except as explicitly permitted by law.

Third-Party Services, App Stores, and Payment Providers

NAVIA may use third-party services, including hosting, analytics, mailing services, payment providers, Stripe, Apple App Store, Google Play, technical support tools, and other services necessary for product operation.

Use of such services may be governed by additional rules of respective third parties. NAVIA is not responsible for third-party actions to the extent such actions are outside NAVIA's reasonable control, unless mandatory law provides otherwise.

Bank card payment processing, purchase of subscriptions, tokens, digital features, boosts, gifts, and voluntary support must be performed through payment providers or infrastructure compliant with applicable security requirements and platform rules. NAVIA shall not store full bank card details where such processing is delegated to an external payment provider.

Data Protection and Privacy

Processing of user personal data is described in the NAVIA Privacy Policy and related documents on consent, cookies, analytics, advertising, account deletion, and sensitive data processing.

By using NAVIA, the user understands that for service operation NAVIA may process registration data, profile data, photos, messages, complaints, geolocation, payment information, subscription information, tokens, token balance, token spending history, digital gifts, voluntary support, technical data, security data, and other information described in the Privacy Policy.

The user may have rights of access, rectification, deletion, restriction of processing, data portability, objection to processing, withdrawal of consent, and complaint to a supervisory authority in cases and within limits provided by applicable law.

If the user provides information that may be classified as sensitive or special category data, including information on religious views, such information is processed in accordance with the user's separate consent or another applicable legal basis.

Changes to the Service and These Terms

NAVIA may modify, update, improve, restrict, suspend, or discontinue certain service features, including free and paid features, interface, algorithms, recommendations, AI features, test features, safety rules, and technical parameters, where necessary for product development, safety, legal compliance, service quality, or NAVIA's business model.

NAVIA may update these Terms and related documents. Minor, technical, editorial, or clarifying changes may take effect without separate individual notice unless law requires otherwise.

Material changes affecting user rights, paid features, data processing, or service use procedures may be communicated to users through the app, website, email, push notification, Telegram, login screen, or another available method, where such notice is required or appropriate.

Continued use of NAVIA after updated Terms become effective means acceptance of updated Terms unless applicable law requires separate active consent. If the user does not agree with the changes, the user must stop using NAVIA and, where necessary, delete the account or cancel the subscription.

Changes that require separate consent under law take effect for the user after such consent is obtained or another applicable legal basis exists.

Service Availability, Test Mode, and Technical Limitations

NAVIA may be in development, testing, limited launch, phased feature rollout, or technical update mode. During such periods, certain features may operate unstably, be unavailable, be changed, be removed, or be provided to a limited number of users.

NAVIA strives to maintain service operability but does not guarantee continuous, error-free, secure, fully device-compatible, or fully available operation at all times.

NAVIA is not liable for failures, delays, errors, unavailability, partial loss of functionality, or incompatibility caused by technical works, actions of third parties, communication failures, app store updates, device limitations, force majeure, or other circumstances outside NAVIA's reasonable control, to the maximum extent permitted by law.

Disclaimer of Warranties and Limitation of Liability

NAVIA is provided on an “as is” and “as available” basis, to the maximum extent permitted by applicable law.

NAVIA does not guarantee that the service will meet all user expectations, operate without errors, provide a specific dating outcome, prevent all user violations, or verify the accuracy of every profile.

To the maximum extent permitted by applicable law, NAVIA, the operator, team members, contractors, partners, and affiliates are not liable for indirect, incidental, special, punitive damages, lost profits, data loss, reputational harm, emotional distress, user actions, or interactions outside the service.

Where NAVIA liability cannot be fully excluded, it is limited to the maximum amount allowed by applicable law. For paid users, where law permits such limitation, NAVIA's aggregate liability may be limited to the amount actually paid by the user to NAVIA for the relevant paid feature during the month preceding the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot be excluded or limited under applicable law, including liability for intentional misconduct, gross negligence, injury to life or health where such limitation is prohibited by law, and mandatory consumer rights.

Indemnification, Governing Law, and Disputes

To the maximum extent permitted by applicable law, the user agrees to indemnify NAVIA for reasonable losses, costs, claims, and demands arising in connection with the user's breach of these Terms, law, third-party rights, Community Rules, fraudulent actions, unlawful content, or improper use of the service.

These Terms are governed by the laws of Poland unless otherwise required by mandatory rules of the consumer's country of residence or other applicable law.

Disputes shall be resolved by competent courts of Poland unless mandatory consumer protection rules grant the user the right to apply to a court or authority at their place of residence or another mandatory jurisdiction.

Before initiating court proceedings, the parties should, where possible, attempt to resolve the dispute in good faith by contacting NAVIA support at info@navia.land or legal matters at office@navia.land.

For users in the United States, to the maximum extent permitted by applicable law, disputes must be resolved on an individual basis and not as a class, representative, or consolidated action, where such limitation is permitted by applicable law.

Final Provisions

If any provision of these Terms is held invalid, unlawful, or unenforceable, the remaining provisions remain in effect to the maximum extent permitted.

NAVIA's failure to enforce any right or provision of these Terms does not constitute waiver of such right or provision.

The user may not assign rights and obligations under these Terms without NAVIA's prior written consent. NAVIA may assign its rights and obligations in connection with reorganization, sale of business, transfer of project, change of operator, investment, or another lawful transaction, subject to compliance with applicable data protection and consumer rights legislation.

These Terms constitute the agreement between the user and NAVIA regarding service use and replace previous versions of terms unless otherwise expressly stated by NAVIA.
